Legal Update From Labor Attorney Jonathan Judge

Staying on top of new legislation couldn’t be easier for EAOC members, since we have Labor Attorney Jonathan Judge in our roster!

Jonathan Judge, Partner with Atkinson, Andelson, Loya, Ruud & Romo, advises employers in various labor and employment law matters, including drug testing, mass layoffs (WARN), disparate impact analysis, immigration compliance, trade secrets, privacy, technology in the workplace, piece rate compensation, municipal and state sick leave, local, state and federal minimum wage law, and the Patient Protection and Affordable Care Act.

At this week’s morning meeting, members received updates on California’s New Workplace Violence Prevention Plan Law, or SB 553.

Some key takeaways from the presentation were:

  • Cal/OSHA engaged in the rulemaking process since 2017
  • There is a draft Workplace Violence Regulation currently in the review process before the Cal/OSHA Standards Board
  • Workplace Violence Prevention Plan (WVPP) – SB 553 (Labor Code 6401.9) was effective July 1, 2024.

Also discussed were Cal/OSHA Penalty amounts which went into effect on January 1, 2023:

  • The maximum penalty for general and regulatory violations, including posting and recordkeeping, is now $15,375;
  • The maximum penalty for serious violations is $25,000;
  • The minimum penalty for willful violations is $10,981;
  • The maximum penalty for willful and repeat violations is $153,744

I ended up buying it, building a warehouse and running my business at the time (South Coast Stationers) there for about thirty years. It was an excellent investment.
