Legal Update From Labor Attorney Jonathan Judge

Staying on top of new legislation couldn’t be easier for EAOC members, since we have Labor Attorney Jonathan Judge in our roster!

Jonathan Judge, Partner with Atkinson, Andelson, Loya, Ruud & Romo, advises employers in various labor and employment law matters, including drug testing, mass layoffs (WARN), disparate impact analysis, immigration compliance, trade secrets, privacy, technology in the workplace, piece rate compensation, municipal and state sick leave, local, state and federal minimum wage law, and the Patient Protection and Affordable Care Act.

At this week’s morning meeting, members received details on California’s Legislative Updates for 2025.  Some key takeaways were:

AB 2123 (Revisions to Paid Family Leave Administration):

• California Paid Family Leave (PFL) is a state-run program providing income-replacement benefits to employees taking time off to care for a covered family member with a medical condition, to bond with a new child, or to participate in a qualifying exigency related to covered active duty or a call to covered active duty for an employee’s spouse, domestic partner, child, or parent in the Armed Forces of the United States

• AB 2123 eliminates an employer’s ability to require employees to use accrued vacation time before accessing PFL benefits

• Previously, employers could require employees to take up to two weeks of accrued vacation before employees could become eligible for PFL benefits

AB 2499 (Expansion of Crime Victim Leave):

• Currently, California’s crime victim leave laws are codified within Labor Code § 230, et seq.

• AB 2499 repeals some of these Labor Code provisions and recasts them as unlawful employment practices under the FEHA

• This bill expands the list of crimes for which employees can take time off under California’s crime victim leave law and allows employees to take that leave to assist family members who are victims of crimes

 

SB 1100 (Driver’s License Discrimination):

• SB 1100 adds to the Fair Employment and Housing Act a new provision that makes unlawful for an employer to include a statement in a job advertisement, posting, application, or other material, that an applicant must have a driver’s license, unless: (1) the employer reasonably expects driving to be one of the job functions for the position; and (2) the employer also reasonably believes that satisfying the job function using an alternative form of transportation (e.g., carpooling or walking) would not be comparable in travel time or cost to the employer.
